Dénia returns to urbanism of 1972: the courts annul the Transitory Urban Regime (RUT)

The Administrative Litigation Room of the Supreme Court has declared null the Transitory Urban Development System (RUT) that until now was in force in Denia "for being contrary to the legal system". The main reason for this annulment is that the RUT approval process was not submitted to public information at the time.

In this way, the Supreme Court estimates the appeal filed by a commercial company against Decree 54 / 2013 of the Consell, which suspended the validity of the PGOU 1972 and established the RUT, which leaves Dénia in urban chaos due to lack Of any planning.

It is important to remember that the PGOU of 1972 does not comply with all the current urban regulations, so this situation could happen because the City Council requests the intervention, urbanistically speaking, of the Generalitat Valenciana while approving the new General Plan of Urban Planning.

From the City Council are studying the current situation with the Ministry to analyze the actions to be implemented. It is expected that in the next few hours they will take stock of the situation.

Last April, the Consell of the Generalitat Valenciana approved the extension, for two more years, of the Transitory Urban Development System (RUT) that currently governs the city of Denia. As they say from the autonomous entity, "Because this municipality is currently in the process of processing its new general plan, this is why the city council has requested the extension of these regulations until the 3 of May 2019, date that the Consell has considered sufficient to allow there is a definitive approval of the General Urban Planning Plan ".
