The Catalan Ombudsman admits Obrim el Center's complaint for the closure of Marqués de Campo

The Síndic de Greuges of the Valencian Community has admitted to processing the complaint presented by the Platform Obrim el Center against the decision of the Dénia City Council to leave the bollards that close to traffic permanently raised Glorieta of the Valencià Country and the Calle Marques de Campo.

Obrim the Center has requested the support of the Catalan Ombudsman considering that the Dianense administration is "acting against its own administrative acts and puts our most fundamental rights at risk." The platform considers that although the City Council has full powers over internal traffic of the city, the municipal plenary session approved the Mobility Plan included in the PGE on two occasions, in plenary sessions on April 8, 2019 and December 17, 2020, and that said plan provides for a series of infrastructures and actions prior to the pedestrianization of the street that have not been executed.

Moreover, in the Dénia Strategic Plan, also contracted by the Government team, it is also committed to pedestrianization always after an integrated action in the area that has not been done either. For this reason, and despite municipal powers, the decision to close the Plaza de la Glorieta and Calle Marqués de Campo could be considered, according to Obrim el Center, "arbitrary acts" and this is shown in the document of the platform raised to the Síndic.

Right of access

Due to this, with this closure, Obrim el Center indicates, "the neighbors cannot normally access our homes, not even to unload belongings or access with people with reduced mobility, as is our right". In the case of shops, hotels, establishments of all kinds and the Municipal Market "are suffering serious economic losses."

With regard to professionals established in offices in the area, “they cannot access normally, nor can people who work in the center”, to the point that “delivery vans are forced to double-park alongside to the bollards that close the street, causing many traffic jams. "

Documentary evidence

In its complaint, the platform also reports the result of the meetings held with municipal officials in this regard, such as the explanation given that “if the street was opened to traffic, the hoteliers would not be able to take tables outside”, which in Obrim's opinion the Center is false. The sidewalks of Calle Marqués de Campo measure between 4 and 4,50 meters "so the safety distance would be fulfilled even with the tables on the sidewalks." Furthermore, in other streets with similar characteristics, hoteliers have been allowed to take tables out onto the public thoroughfare without closing traffic, for which they have also provided documentary evidence before the Catalan Ombudsman.

In the letter of admission for processing, the Catalan Ombudsman informs the platform that “we have requested the Dénia City Council to inform us about the determinations of the mobility plan and the Dénia strategic plan in relation to the pedestrianization of Marqués de Campo street and Plaza de la Glorieta, and any other aspect related to the closure of the aforementioned roads to road traffic ”.
