The Supreme Court annuls the Transitory Plan Dénia

In December 2005, and after years trying to create a new General Plan, Dénia approved a transitional plan so as not to have to continue with the one currently in force, that of 1972. Three years later, on September 22, 2008, the Association affected by Almadrava-Molins filed a contentious-administrative appeal against this approval, and it was then the Generalitat Valenciana that filed an appeal in cassation against this judgment.

Yesterday, September 26 2012, the 5ª Section of the Division of Administrative Litigation of the Supreme Court dismissed the appeal of the Government, agreeing with the Association of affected Almadrava-Molins and annulling the Transitory Plan of Dénia.

According to the judgment, the reasons to cancel the plan are "Failure to comply with the legally established procedure, by contravening the pronouncements contained in mandatory and binding sector reports or not having requested any of them". That is, that once some changes were requested in reports concerning coasts and roads, but never changed.

The Mayor of Dénia, Ana Kringe, Urges caution at this news because today they will devote to hold talks with Juan Giner, Director General of Urban Planning Ministry to clarify the situation. In addition the council is awaiting the assessment of the technical's own planning department and Department.

This was to be one of the items on the regular full held this afternoon, but evidently removed from the agenda until more details are known.
