One year and three months in prison for the local Dénia police officer responsible for the homophobic persecution against councilor Javier Scotto

A Benidorm court has convicted the former Dénia local police officer Eugenio Crespo for various homophobic acts and comments committed since mid-2016 directed towards Javier Scotto, councilor, already at that time, of Citizen Security. According to the sentence handed down on September 14, the convicted man was responsible for a series of denigrating publications related to Scotto's sexual orientation on his Facebook account. On December 28, 2017 even He even appeared at a plenary session of the City Council, the last of the year, with a t-shirt with the word "faggot", revealing it once he was in front of the councilman.

The sentence, as made public by La Marina Plaza, holds Crespo, who participated in the last elections on the Vox Dénia list, responsible for two crimes. The first is related to the public humiliation of a person due to their sexual orientation, thus violating the fundamental rights and public freedoms guaranteed by the Constitution, as established in article 510 of the Penal Code. The second offense refers to the injuries suffered by Scotto as a result of the first, as the councilman needed 172 days to recover from the injuries.

As a result of the conviction, Crespo faces a prison sentence of 15 months and a fine of 9 months and one day, with a fine of 10 euros, which adds up to a total of 2.700 euros. In addition, he is subject to special disqualification from practicing professions or trades related to teaching, sports and free time for a period of more than three years with respect to the prison sentence.

An alleged usurpation as a defense

During the trial, Crespo denied being the author of the homophobic messages on Facebook, suggesting that his account may have been hijacked. However, he never reported such usurpation and was unable to provide evidence or witnesses to support his claim. On the other hand, several witnesses confirmed that the messages reflected previous conversations with Crespo, which suggested his authorship.

The ruling concludes that Crespo's acts constitute a crime committed in the exercise of fundamental rights and a crime of injury, while the additional charges raised by the private accusations were not considered in the verdict.

The former police officer, who is now retired, must pay compensation of approximately 13.000 euros to Scotto, who continues in office. This compensation is divided into 6.800 euros for the injuries suffered and 6.000 euros for moral damage. It is important to note that the sentence is not final and an appeal can be filed before the Alicante Court.
