The new law changes Cadastral taxation of developable land in Dénia for not having a General Plan

The absence of an urban planning in Dénia continues generating conflicting situations for the municipal coffers of Dénia. The last one we have known has been announced by entrepreneurs CEDMA, and so they transmitted it to the mayor and the councilor of finance in the last meeting held.

As they explained, the new Law 13 / 2015 of Reform of the Mortgage Law, establishes that "Developable land without detailed or detailed development planning must be classified as real estate of a rustic nature and new criteria are approved for its valuation taking into account its location circumstances".

What do means this? That lands that until now were classified as urbanizable land, and that paid a high amount of IBI, become rustic in nature, so they will pay significantly less in the Real Estate Tax. Good news for the owners, who will reduce their spending, but bad for the City Council, which will see how the collection of the municipal coffers decreases next year. A situation that would not happen if Dénia had a general plan in motion.

In the meeting held with Vicent Grimalt y Paco Roselló, the municipal managers informed the entrepreneurs that currently the Department of Intervention has requested to Urbanism a list of the affected lands in order to calculate the IBI that is currently paid for its taxation and to know how much their income would be reduced.

Of course, neither Grimalt nor Roselló know when this new law will be applied. If it is applied next year, employers warn that it will be necessary to compensate the owners who have paid more since the approval of the law.
