The Catalan Ombudsman admits Obrim el Center's complaint for the closure of Marqués de Campo

The Síndic de Greuges of the Valencian Community has admitted to processing the complaint presented by the Platform Obrim el Center against the decision of the Dénia City Council to permanently leave the bollards that close the Glorieta del País Valencià and Calle Marqués de Campo to traffic.

Obrim el Centre ha pedido el amparo del Síndic al considerar que la administración dianense está «actuando en contra de sus propios actos administrativos y pone en riesgo nuestros derechos más fundamentales”. Considera la plataforma que si bien el Ayuntamiento tiene competencias plenas sobre el tráfico interno de la ciudad, el pleno municipal aprobó en dos ocasiones el Plan de Movilidad incluido en el PGE, en los plenos del 8 de abril de 2019 y el 17 diciembre de 2020, y que dicho plan prevé una serie de infraestructuras y actuaciones previas a la peatonalización de la calle que no se han ejecutado.

Es más, en el Plan Estratégico de Dénia, contratado también por el equipo de Gobierno, se apuesta asimismo por la peatonalización siempre posterior a una actuación integrada en la zona que tampoco se ha hecho. Por este motivo, y pese a las competencias municipales, la decisión del cierre de la plaza de la Glorieta y la calle Marqués de Campo podrían ser considerados, según Obrim el Centre, «actos arbitrarios» y así se pone de manifiesto en el documento de la plataforma elevado al Síndic.

Due to this, with this closure, Obrim el Center indicates, "the neighbors cannot normally access our homes, not even to unload belongings or access with people with reduced mobility, as is our right". In the case of shops, hotels, establishments of all kinds and the Municipal Market "are suffering serious economic losses."

With regard to professionals established in offices in the area, “they cannot access normally, nor can people who work in the center”, to the point that “delivery vans are forced to double-park alongside to the bollards that close the street, causing many traffic jams. "

Documentary evidence

In its complaint, the platform also reports the result of the meetings held with municipal officials in this regard, such as the explanation given that “if the street was opened to traffic, the hoteliers would not be able to take tables outside”, which in Obrim's opinion the Center is false. The sidewalks of Calle Marqués de Campo measure between 4 and 4,50 meters "so the safety distance would be fulfilled even with the tables on the sidewalks." Furthermore, in other streets with similar characteristics, hoteliers have been allowed to take tables out onto the public thoroughfare without closing traffic, for which they have also provided documentary evidence before the Catalan Ombudsman.

In the letter of admission for processing, the Catalan Ombudsman informs the platform that “we have requested the Dénia City Council to inform us about the determinations of the mobility plan and the Dénia strategic plan in relation to the pedestrianization of Marqués de Campo street and Plaza de la Glorieta, and any other aspect related to the closure of the aforementioned roads to road traffic ”.
