The Síndic de Greuges files the file against the closure of Marqués de Campo

The City Council of Dénia has received a communication from the office of the Síndic de Greuges of the Valencian Community, Ángel Luna, in which the file of the file opened by the receivership as a result of the complaint presented by a citizen for the closure of traffic of Marqués de Campo street.

The Catalan Ombudsman's response, once the argument sent by the council with all the legislation, precedents and related actions that justify the municipal decision has been studied, is the following: "We conclude our investigation, since it does not follow that the action of that administration (the City Council of Dénia) has violated any of the rights, freedoms or principles recognized in the Spanish Constitution and in the Statute of Autonomy ".

The ombudsman's brief adds that: "Consequently, and given that the person concerned has not provided us with any information that would advise us to continue our investigation, we proceed to close the file with the file of all his actions.

Among the arguments put forward by the city council to validate the closure to traffic of Marqués de Campo as adjusted to the law, collected in the report sent to the Catalan Ombudsman, highlights the inclusion of the pedestrianization process that will be undertaken shortly on this main road in the progressive pedestrianization, underway for years, of the historic city center. And as a compensatory measure for this strategy, the 3.000 free public parking spaces distributed around the urban area and less than 10 minutes from the center are pointed out.

Likewise, it insists on the trigger for the acceleration of the definitive closure of Marqués de Campo, which until now was closed seasonally (summer period, weekends and holidays): the need to adapt certain public spaces to the new needs and derived prevention of the pandemic and the desire to allow the hospitality sector to reassemble its terraces, with the required distances and safety measures.

On the other hand, the different municipal studies that ratify the closure decision were attached to the answer; both those issued specifically for the health alert context and others, previous and current, related to the revitalization of the city (Commercial Action Plan, 2008; Dénia Strategic Commerce Plan 2021-2025; Sustainable Urban Mobility Plan, of 2008; Mobility study of the General Structural Plan of Dénia; Director plan 'Dénia Smart City'; Tourism sustainability plan), which advocate the pedestrianization of the urban center as a measure that favors the economy and sustainability.

Finally, it explains how access to the necessary assistance has been guaranteed in case of emergency (firefighters, police, toilets have keys to lower the bollards that delimit the pedestrian zone and, in any case, with a call to the Local Police, the municipal agents come to open the street); and it is also advanced that the Dénia City Council is working on the drafting of the ordinance that will regulate access to Marqués de Campo for loading and unloading and for residents who need to enter in certain specific cases.
