The General Directorate of Sports of the Ministry of Education, Culture and Sports has resolved on June 16, 2020, the call for subsidies for the improvement, expansion or repair of sports facilities for the year 2020, rejecting the request of the Eatim de Jesús Pobre both in modality A and B, rehabilitation of sports facilities as traditional pediment facilities, for estimating Jesús Pobre as a non-beneficiary entity, like the rest of Minor Local Entities, as it is not a municipality.
The Eatim de Jesús Pobre, through a plenary session dated July 21, 2020, has unanimously agreed to file an optional appeal for reinstatement against said resolution as it is considered unfair and against the Valencian Local Regime law, mainly for these three reasons:
- That the bases of the 2017 call, which were already applied in the 2019 grants, estimated Jesús Pobre as a beneficiary entity, although it was dismissed for exhaustion of the budget credit.
- With the same application bases, the Minor Local Entity of El Perelló was the beneficiary for the construction of a skate park, for an amount of € 96.109,84 in that year.
- The resolution of this annuity violates articles 61, 60.2, 57 and 54 OF THE VALENCIAN LAW 08/2010, of June 23 of Local Regime, in particular in article 60.2 that textually regulates that "... Minor local entities may request aid and subsidies provided for the municipalities and carry out any act or administrative management of a similar nature on matters within its competence. ”
In accordance with the above, the resolution dated June 16, 2020, from the Director General of Sport attacks the legal personality and capacity of the Local Minor Entities, as well as the issuance of a resolution that goes against their own acts given that in the previous annuity did recognize their beneficiary status.
The Neighborhood Board regrets continuing in the same situation of lack of equalization of the Minor Local Entities with the municipalities and other Local Entities, as well as the need to advance in self-government and municipalism.
Along with the optional appeal for reinstatement, in the same plenary session, the Eatim de Jesús Pobre unanimously approved to request the different ministries to expressly include the Local Minor Entities as beneficiaries of the aid and subsidies for the Local Administrations, and also to raise this same proposal to the FVMP, Valencian Federation of Municipalities and Provinces, and AVELA, Valencian Association Jde Autonomous Local Entities for their support and claim.
