Only 24 hours after hearing the annulment of the Transitory Urban Development of Dénia by the Supreme Court, the City of Dénia, advised by the Department of Territory, has decided to remedy the defect in a way that has led to the annulment of the previous RUT.
This defect in form is due to the fact that in its day, the Department that presided the PP in the Generalitat, did not expose the document to the public before its final approval, so now the City of Dénia wants to repeat the steps set by law.
The Councilor for Urban Planning, Maria Josep Ripoll, explained that his department is currently working on the drafting of a new RUT, which will be based on the previous one but which will be adapted to the new regime established by the LOTUP (Law on Territorial Planning, Urbanism and Landscape), in addition to including some modifications that were intended to be approved in the extraordinary plenary session called for tomorrow, Friday morning.
From the City Council they estimate that the writing of this new RUT will take them two weeks. Then, the document will be sent to the Ministry for public exposure, step that was skipped on the previous occasion, and finally be approved by the regional body.
Although the City Council does not dare to talk about deadlines, they expect the process to be as fast as possible, since both at the regional and local level, it is in the interest of urban planning in Dénia to have minimum transitional rules that allow progress.
In this sense, Ripoll has remarked that during the processing of this new document will not pose any problem for the licenses of minor work in the municipality. However, the town planning department should study all other licenses requested to check whether they are legal or not, taking into account the urban impas in which the city will remain during that time.
It should be recalled that, pending the suspension of the RUT, the plan now in place in Denia is 1972, which is based on the law of the year 1956, a law that has nothing to do with the current reality of the municipality. That is why they discard the possibility of granting licenses of major work during all this time.
The Mayor of Dénia, Vicent Grimalt, Reminded that, regardless of this obstacle, the City Council continues to work on the drafting of the new General Structural Plan, with the aim of approving it at the beginning of the year 2018. For his part, the deputy mayor, Rafa Carrió, Has insisted that during this process they are consulting both the advisers of the government team and the advisers of the Generalitat.
The rush, the culprits of this situation
During the assessment of the situation, the councilwoman Ripoll said that Dénia is in this situation "to be in a hurry" and not do things for their course. For his part, Grimalt recalled that "this situation would not have occurred if the PP had approved a general plan during the seven years of government," recalling the motion of censure of 2008.
